Ex-Goldman Sachs programmer to avoid jail?
The case of programmer Sergey Aleynikov, who was accused of stealing proprietary code from Goldman Sachs, may end with more of a whimper than a bang. Despite a flood of media coverage, the kind that Goldman Sachs often generates, Reuters reports that Aleynikov plans to seek a resolution that will result in a deferred prosecution agreement or a plea to a misdemeanor. Prosecutors say they intend to "evaluate'' the request for a deferred prosecution, which basically means that charges will be dropped if Aleynikov meets certain conditions.
This certainly suggests that the case against Aleynikov is rather weak, as people have been speculating for a while. It doesn't appear that there's much evidence that the former employee sought to profit from the code. Still, it raised a lot of awareness about the need to protect your assets from employees.
